In a judgement that will reassert, and rightly so, the authority of family over young adults, the Allahabad High Court has dismissed a petition by an inter-faith couple.

The Allahabad High Court came down heavily upon the petitioning couple, lambasting in the process the very nature of the live-in, arguing that it is alien to the Indic culture of Bharat.

Nature Of The Case


The couple had filed a petition in the hon’ble high court seeking protection from the police as they were in a live-in relationship.

The High Court rejected the petition, arguing that live-in is more about ‘infatuation’ than ‘real love’.

The Allahabad High Court argued that young adults in the age group of 20-22 do not have a realistic perception of the world around them.

They live in a fool’s paradise.

The couple moved the court to seek police protection.

They filed a petition to cancel an FIR lodged against the man by the woman’s aunt under Section 366 (kidnapping, abducting or inducing a woman to compel marriage) of the Indian Penal Code.

High Court’s Observation


A two-judge bench of Justices Rahul Chaturvedi and Mohammed Azhar Husain Idrisi said “We cannot expect that the couple would be able to give serious thought over such types of temporary relationship. As mentioned above, it is more of infatuation against the opposite sex without any sincerity”.

The court also stated that live-in relationships are “temporary and fragile” and “timepass”.

Why This Is A Timely Judgement


The Bharatiya civilization is standing at the cusp of transformational changes.

Human society in the age of globalization sees a global exchange of ideas. Bharatiya samaj is no different.

But of late we have been noticing increasing westernization among the millenials and Gen-Z, especially when it comes to privacy and personal liberties.

Bharat is not like the west, here the institution of the family plays a pivotal role in determining the future of an individual.

But live-in relationships has driven a hole in the solidarity of the Indian family unit.

This cannot be allowed to eat into the moral vitals of Indic values.

Live-in was, is and will be an alien concept that must not be allowed to undermine the Indian social fabric.

Hence, Allahabad High Court criticizes live-in concept is a timely step.
